STAND DOWN 

With the exception of reasonable suspicion the company cannot dstand down a covered employee pending the result of a DOT required drug test. 

Exception:

The company has been granted a stand down waiver, issued by the director of the mode of transportation under which you are covered. 

STAND DOWN WAIVER 
If you have applied for and been granted a stand down waiver you can stand down employees pending the result of a DOT drug test.  To apply for a waiver,  contact the drug office or download the application from the web

****TO DATE VERY FEW WAIVERS HAVE BEEN GRANTED ********

• Let the MRO know if you are the recipient of a DOT stand down waiver - The MRO will require a copy of the waiver for their files (will be reviewed in a DOT audit)

You cannot remove a covered employee from his/her duties because the MRO or his staff contacts you unless you are given a result or have a stand down waiver.

• You must only stand down the employee once you are given a confirmed positive, substituted or adulterated test result. 
• Reasonable suspicion testing - the donor is Automatically taken out of service.
• Use common sense if a donor admits to a problem prior to the MRO reporting the result -  Document the admission and stand down based on the admission.
• Your company policy CANNOT and WILL NOT override the DOT stand down rule.

FMCSA -   ADMISSION OF USE PRIOR BEING SELECTED FOR TESTING

• If your company selects to include the admission of use, state this  in your DOTcompany  policy.
• No test has been conducted, the employee can be asked to stand down and is subject to Return To Duty  protocol if they admit to a drug or alcohal abuse problem prior to the requirement of any test.
• The company cannot take any adverse action (ex: termination or leave without pay) against the individual other then removal from the safety sensitive position.
• THE DOT Return To Duty  PROGRAM MUST BE INIATED IMMEDIATELY.
